Terms of Service

These terms are an agreement between you and [Legal business name] ("InstaWebCart", "we", "us"), [Registered business address]. They apply when you create an InstaWebCart account or use InstaWebCart to run an online store. If you use InstaWebCart for a business, you accept them for that business.

1. The service

InstaWebCart lets you create and run online stores: a storefront, an admin to manage products, orders and customers, themes, and connections to payment gateways and courier services. What each plan includes is shown on our pricing page and on your billing page. We improve the service over time and may change or remove features; if a change takes away something important on your plan, we'll tell you in advance.

4. Your store and your customers

You're the seller in every sale your store makes. You're responsible for your products and their descriptions, prices and taxes; for shipping, returns, refunds and customer service; for your store's own terms and policies; and for following the laws that apply to you, including the Consumer Protection (E-Commerce) Rules, 2020 and GST law. Your customers pay into your own payment gateway account (Razorpay, Stripe, Cashfree or PhonePe); InstaWebCart isn't a party to your sales and doesn't hold your customers' money.

5. Acceptable use

You may not use InstaWebCart to sell or promote anything illegal in India, including counterfeit goods, weapons, drugs, prescription medicines without the required licences, or content that is obscene, hateful or infringes someone else's rights. You may not use it for fraud, phishing, spam or malware, try to break into or overload our systems or other stores, or copy or resell the service. We may remove content or suspend a store that breaks these rules or the law, and where we can, we'll tell you why first.

6. Content and intellectual property

You own your store's content: products, images, text and data. You give us permission to host, copy and show it only as needed to run your store and the service. InstaWebCart, its software and its themes belong to us; while your account is active you may use them for your stores.

7. Personal data

How we handle personal data is described in our Privacy Policy. For your customers' data, you decide what is collected and why, and we process it on your behalf to run your store. You're responsible for telling your customers how you use their data.

8. Availability

We work to keep InstaWebCart available and secure, and we back up data regularly, but we can't promise the service will never be interrupted. We may carry out maintenance, usually at quiet hours in India. Keep your own copies of anything critical.

9. Suspension, closing and your data

You can stop using InstaWebCart at any time by cancelling your plan. We may suspend or close an account for non-payment, a serious or repeated breach of these terms, or when the law requires it. After your access ends we keep your store's data for at least 90 days so you can come back; after that we may delete it, after emailing you first. Ask us at [Support email] if you want your data deleted sooner or a copy of it.

10. Liability

InstaWebCart is provided "as is". As far as the law allows, we're not liable for indirect or consequential losses such as lost profits, lost sales or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

11. Indemnity

You'll compensate us for claims made against us by others because of your products, your store's content or your breach of these terms or the law.

12. Changes to these terms

We may update these terms. For changes that matter, we'll email you or show a notice in your dashboard at least 15 days before they apply. Continuing to use InstaWebCart after that means you accept the new terms.

13. Law and disputes

These terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute. Otherwise, the courts at [City for courts, e.g. Bengaluru] have exclusive jurisdiction.
